Preamble
The website www.terrass-hotel.com , hereinafter referred to as "the website", is a hotel booking tool.
It is published by Biografy Group, with a capital of €27,011,535, whose registered office is located at 32, avenue de l'Opéra – 75002 PARIS and registered with the Paris Trade and Companies Register under number RCS 429 706 781. For the application of these general terms and conditions of sale, it is agreed that the customers and TERRASS' HOTEL shall be collectively referred to as the "Parties" and individually as a "Party", and that the user who has validated a reservation or an order shall then be referred to as a "customer".
These terms and conditions of sale apply to all countries and all currencies. Any reservation or order implies full acceptance of these terms and conditions of sale.
TERRASS HOTEL reserves the right to modify these terms and conditions of sale at any time by publishing a new version on the Website. The applicable terms and conditions of sale remain those in effect on the date of the reservation or order.
ARTICLE 1: GLOSSARY
"Confirmation Email": An email sent by TERRASS HOTEL as the final step in the booking or ordering process. This email summarizes the reservation validated by the customer and confirms its receipt by the website www.terrass-hotel.com . The confirmation email constitutes a booking confirmation as defined below.
"Booking Confirmation": An electronic document summarizing the details of the services booked after the booking process and its validation by the Customer. The booking confirmation is issued, in particular, after a reservation made on the website www.terrass-hotel.com , during which the customer enters their credit card number for online payment or as a guarantee before final validation.
"Establishment Contract": Contract whose purpose is the provision by the TERRASS" HOTEL establishments of all the services defined below and which have been effectively ordered by the Client following the validation of his online reservation or by another method of reservation.
“Client”: A natural person of legal age with full legal capacity at the time of signing the establishment’s contract.
“Reservation request”: Request to reserve rooms or restaurant tables, made by the customer via mobile communication services or the internet.
“Mobile services”: All services and protocols enabling mobile phones to connect to the Internet, and enabling in particular the consultation and booking of services provided by TERRASS” HOTEL.
“Online booking”: Booking of rooms, restaurant tables and any additional accessories or services offered by TERRASS” HOTEL establishments on its website www.terrass-hotel.com .
"Reservation by telephone or email": Reservation of rooms or additional services offered by the TERRASS HOTEL by telephone call or by sending an email by the Client, responding to the reservation registration process as described in these general terms and conditions of sale.
"establishment": Refers to the TERRASS HOTEL establishment comprising rooms or any other ancillary services offered on the website www.terrass-hotel.com .
"Services": Services offered by TERRASS HOTEL, under a contract with the establishment, consist of providing rooms whose essential characteristics are presented on the website www.terrass-hotel.com, with or without meals and/or breakfasts and other additional services related to temporary accommodation, including artistic entertainment. These services, in accordance with the provisions of Article L. 111-1 of the French Consumer Code, are listed on the website www.terrass-hotel.com .
“Extras”: Services marketed by TERRASS HOTEL consisting, within the framework of a contract between the establishment and the clients, of services different and complementary to those offered in the provision of rooms whose essential characteristics are presented on the website www.terrass-hotel.com .
“Website”: electronic service operated by TERRASS HOTEL on the internet and accessible via the following URL: www.terrass-hotel.com .
“WAP”: a communication protocol whose purpose is to allow access to the Internet using a mobile terminal.
ARTICLE 2: SCOPE OF APPLICATION
2.1 SCOPE
These general terms and conditions apply, without restriction or reservation, to all services offered on the website www.terrass-hotel.com by TERRASS HOTEL, which operates the aforementioned site, in particular for the purpose of booking rooms and other services complementary to temporary accommodation in the establishment.
2.1.2. These General Terms and Conditions apply to all subscription operations for the services defined above carried out by the Client.
2.2 TERRITORY
The services listed on this website are offered to be provided to the Client by TERRASS' HOTEL in one of its establishments to the exclusion of any other location following an effective reservation by the Client.
2.3 DURATION
2.3.1. These general terms and conditions apply for the entire duration that the services are available online through TERRASS HOTEL on its website www.terrass-hotel.com
2.3.2. TERRASS HOTEL reserves the right, without notice or compensation, to temporarily or permanently close the website www.terrass-hotel.com or the online booking area.
2.3.3. TERRASS HOTEL is not responsible for damages of any kind which may result from a temporary unavailability or even the permanent closure of all or part of the site or the services associated with it, such as the online booking area.
2.4 LEGAL FRAMEWORK
2.4.1. These general terms and conditions are subject to the provisions of Articles L. 121-16 et seq. of the Consumer Code.
2.4.2. Any reservation for the consumption of the services defined above, made on the website www.terrass-hotel.com is subject to these general and specific pricing conditions for each of the said TERRASS" HOTEL services listed below.
2.5. PURPOSE
2.5.1. These general terms and conditions define the rights and obligations of the parties in the context of remote booking of services offered by TERRASS HOTEL on its website www.terrass-hotel.com
2.5.2. They govern all the steps necessary for the booking and monitoring of the booking between the contracting parties, its maintenance and its validity.
ARTICLE 3: CUSTOMER CAPACITY AND ACCEPTANCE
3.1 The customer does not have a legal right of withdrawal when purchasing a stay online. Indeed, Article L. 221-21-8 12° of the Consumer Code stipulates that the right of withdrawal cannot be exercised, among other things, for contracts for accommodation services.

3.2. All Clients acknowledge having the legal capacity to enter into a contract under the conditions described in the general terms and conditions presented below, i.e., being of legal age and not under guardianship or conservatorship. However, the management of the establishment reserves the right to request proof of identity from the Client upon arrival at the establishment, including, in particular, their date of birth.
3.3. The Client acknowledges that these conditions form an integral part of the establishment's contract.
3.4. The Client agrees that the General Terms and Conditions, the contractual documents informing him of the specific services and prices of each of the services, as well as the order forms and the procedures for doing so, will be presented to him online on the website www.terrass-hotel.com for the purpose of concluding the Contract of the establishment.
3.5. The Client declares having obtained from TERRASS HOTEL all the necessary information on the website www.terrass-hotel.com
3.6. The Client acknowledges having read these general terms and conditions, having accepted them, as well as all the terms of the proposal before placing his order and accepting all of its terms.
3.7. Any online booking confirmation from the website www.terrass-hotel.com by the Client implies prior consultation and acceptance of these general terms and conditions.
3.8. The Client's agreement to these general terms and conditions takes place during the booking process, prior to the validation of their booking.
3.9. The Client, prior to ordering the services, declares that the reservation of these services is made for his personal needs.
3.10. The Client has the option to save and edit these general terms and conditions from the website www.terrass-hotel.com using the standard features of their browser and/or computer, in particular under the "Terms and Conditions" tab.
3.11. The Client expressly accepts that the entry of the required bank details, the acceptance of these general terms and conditions and the validation of the voucher or booking request, constitute an electronic signature within the meaning of Article 1316-4 of the Civil Code which has, between the parties, the same value as a handwritten signature.
3.12. The Client, upon presentation of his identity document as stated in Article 3.1 above, undertakes to complete the individual police form in the countries concerned by this article, in accordance with the provisions of Article R. 611-42 of the Code of Entry and Residence of Foreigners.
ARTICLE 4: SITE CONTENT
4.1. The site mentions the following information:
The identification of the company TERRASS" HOTEL indicating its company name, the address where it is established, its email address.
The essential characteristics of the accommodation offered (the descriptions of each room category can be viewed outside of the booking process under the heading "ROOMS" for each establishment concerned, during the booking process under the room availability calendar and when choosing the room according to the dates chosen by the Client for their booking, which may be illustrated with a photographic image of a room at the same rate. It is specified however that THE PHOTOS ARE NOT CONTRACTUAL insofar as the interior presentation or decoration elements as well as the sizes of the rooms vary within the same establishment or from one establishment to another).
The prices for each of the services related to accommodation and additional services.
Payment terms.
The general terms and conditions of sale.
The validity period of the offer and its price.
The minimum duration of the proposed contract, if applicable.
The absence of a right of withdrawal and, where applicable, the cancellation procedures.
4.2. All information on the website www.terrass-hotel.com is presented in French and English.
ARTICLE 5: RESERVATION
5.1. ONLINE BOOKING PROCEDURES
5.1.1. The Client chooses the services presented on the website www.terrass-hotel.com , which offers him the possibility of booking a room or a table, according to transparent contractual rates with or without options or Extras left to the Client's free subscription.
5.1.2. The Client acknowledges having read the nature, purpose and booking terms of the services available on the website www.terrass-hotel.com and having requested and obtained the necessary and/or additional information to make his booking with full knowledge of the facts.
5.1.3. The Client is solely responsible for the choice of services and their suitability to his needs, so that TERRASS HOTEL cannot be held liable in this regard.
5.1.4. The reservation is deemed accepted by the customer at the end of the reservation process by clicking on the "CONFIRM RESERVATION" field.
5.2. ONLINE BOOKING PROCESS
5.2.1. The reservation is confirmed upon receipt by the customer of the booking confirmation sent by TERRASS HOTEL, or upon online payment by credit card under the conditions referred to in article 5.2.4. A confirmation screen will then appear online.
5.2.2. The Client undertakes, prior to any reservation, to complete the requested information.
5.2.3. The client attests to the truthfulness and accuracy of the information transmitted.
5.2.4. The booking procedure includes, in particular, the following steps, it being specified that it is always possible for the Client to reverse course in the booking process:
Choice of accommodation location: The Client determines the establishment by clicking on the city of stay.
Selection of the start date of the stay (arrival) and the end date of the stay (departure)
If arrival and departure dates are not entered, a calendar will appear showing available and fully booked dates for the previously selected property. For each available date, the calendar displays the best available rate below the date. This rate shows the best available rate per night for a single guest. By clicking on the dates, the guest can select their arrival and departure dates and proceed to the next steps.
Choosing the number of rooms booked: The customer selects the number of rooms for their stay dates with a single click. If booking multiple rooms, the reservation process continues room by room.
Choosing the number of adults for the room: The customer determines the number of adults per room with one click.
Choosing the number of children for the room: The customer determines the number of children per room with one click.
Room Selection and Associated Rates: The Customer selects from the various available rooms and rates by clicking on them, based on the information entered in the previous steps. This information includes essential characteristics such as the room category for the previously chosen date, its price, its level of amenities, any extras included in special offers, cancellation policy, and payment terms. Please note that the photos or renderings on the website are for illustrative purposes only and are not contractually binding.
Selecting Extras: The customer can add one or more extras with a simple click, subject to availability, based on the information entered in the previous steps. These extras display prices, quantities, and specific characteristics. By clicking "add" or "add an item," the customer completes the selection and entry of the items included in the online reservation, without prejudice to the ability to modify the reservation details by going back to the previous booking process.

Finalizing the reservation: by clicking on the "confirm my reservation" button, the customer validates the summarized and displayed elements comprising their reservation and displays the fields necessary for the Customer to enter their identity information, contact details, including postal address, email and telephone number, and the type of stay, as well as the payment method and bank card details used for online payment, for taking a guarantee by bank card details according to the chosen rate; for acceptance of these general conditions; for final validation by the Customer of their reservation by clicking under the "Confirm the reservation" field at the bottom of the page. Before confirming their reservation, the Client can enter a request for clarification or a special request in the designated "Special Requests" field. This request is not contractually guaranteed by TERRASS' HOTEL unless a written confirmation of the request is received, in which case the requested service may be provided, including the price if applicable, for the Client's approval. By clicking "Confirm Reservation," the Client pays or provides a guarantee by credit card according to the selected rate. The final step is TERRASS' HOTEL's registration of the Client's reservation and assignment of a corresponding reservation confirmation number.
5.3. ONLINE CONTRACT FORMATION
5.3.1. In accordance with articles 3.10 and 5.2.4, the Contract of the establishment is formed at the time of the confirmation of the reservation of the Client by TERRASS" HOTEL including the allocation of the relevant reference number as stated in the preceding article.
5.3.2. The establishment's contract can only be formed after the Client has previously selected the content of their reservation, which is fully summarized in the final step of the booking process, accepted these terms and conditions, and finally confirmed their reservation by clicking the "Confirm Booking" button. Otherwise, the reservation is considered cancelled and has no effect.
5.3.3. In all cases of online booking, a summary email is sent to the Client at the email address they provided in the designated field. This email serves as an acknowledgement of receipt of the booking and confirmation, summarizing the terms of the contract, the services booked, the prices, the pricing conditions applicable to the selected rate, information regarding after-sales service and commercial guarantees if any, the procedures for exercising any right of withdrawal or cancellation, as well as the address of TERRASS HOTEL to which the client can submit any complaints.
5.4. OTHER BOOKING METHODS (OTHER THAN "ONLINE")
5.4.1. Reservation by telephone
5.4.1.1. Telephone reservations as defined below are made using the referenced telephone numbers.
5.4.1.2. When a reservation request is made by telephone by the Client, TERRASS' HOTEL will offer the available rates and related additional services based on the Client's request for the dates requested. TERRASS' HOTEL will also request a telephone number and email address to which it will send these general terms and conditions of sale, a summary of the reservation request, and, if applicable, bank details for the purpose of registering the reservation, with or without payment during the booking process of the price, a deposit, or a guarantee by credit card details, depending on the applicable rate determined by the Client when making the reservation request.
5.4.1.3. All information and conditions required by TERRASS HOTEL in response to the Client's telephone reservation request constitute essential formalities for registering the Client's telephone reservation. Without this information, the reservation cannot be validated or confirmed.
5.4.1.4. By providing at least the information requested by TERRASS HOTEL via email, the Client cannot complain about the failure to register their reservation, as the hotel contract is not formed due to the Client's failure to provide this information and these conditions. Only written confirmation of the reservation registration will constitute a binding contract.
5.4.3. Booking by email
5.4.3.1. Reservations made by email, as defined below, are made to the email address indicated on the website pages, namely reservation@terrass-hotel.com
5.4.3.2. When a reservation request is made by email, TERRASS' HOTEL will reply to the email address from which the reservation request was sent, offering available rates and related additional services, based on the Client's request for the requested dates. TERRASS' HOTEL will also send the Client, via the same reply email, these general terms and conditions of sale upon request, as well as a summary of the reservation request and, if applicable, a request for bank details to process the reservation. Payment of the price, a deposit, or a security deposit will be made during the booking process using bank card details, depending on the applicable rate selected by the Client during the reservation request.
5.4.3.3. All information and conditions required by TERRASS' HOTEL in response to the Client's email reservation request constitute essential formalities for the registration of the Client's email reservation. If the Client, having submitted a reservation request by email, fails to comply with the requirements set forth in these general terms and conditions of sale of TERRASS' HOTEL, the Client may not complain about the non-registration of their reservation. Only written confirmation of the reservation registration is considered valid.
5.5 Right of Withdrawal / Cancellation by the Customer:
5.5.1. For Accommodation services (booking rooms within an establishment or other types of accommodation), the Client is reminded that he does not have the right of withdrawal provided for in Article L. 221-18 of the Consumer Code, in accordance with Article L. 221-28 paragraph 12 of the Consumer Code which excludes this right for contracts relating to accommodation services which must be provided on a specific date or during a specific period.
5.5.2. Without prejudice to the provisions of Article 5.5.1, the contractual terms may, where applicable, provide for a right of cancellation, depending on the content of the reservation confirmed by the Client and as indicated for each rate, when the reservation is made under the heading "Flexible Rates". In this case, the Client has been able to review the applicable cancellation conditions. These conditions are also reiterated during the various stages leading to payment.
5.5.3. If the specific terms of the rate allow, and only for reservations made under the heading "Flexible Rates" or under another heading expressly mentioning this right of cancellation, the Client's right to cancel must be exercised before 3:00 PM, two days prior to arrival – Paris (France) time. Late notification of cancellation will result in the application of late cancellation fees equal to the first night's accommodation, plus any extras included in the Client's reservation, according to the applicable rate inclusive of all taxes in the reservation confirmed by the Client.
5.5.4. The cancellation right defined in Article 5.5.2 may be exercised by the Client on the website www.terrass-hotel.com , under the "My Account" page, after logging in with their confirmation number or via email and password. The "Options" tab then offers the option to cancel the reservation. By clicking the "OK" button, the cancellation will take effect immediately, and all packages associated with this reservation will also be canceled. A cancellation confirmation email will then be sent to the client.
5.5.4.1 Depending on the offers selected by the Client, cancellation by telephone is also possible. This must be accompanied by an email from the Client and will be followed by a cancellation confirmation email from TERRASS HOTEL.
5.5.5. In the event of an early departure, the full agreed price will be charged without any right to a refund, credit, or exchange for the unused portion of the stay at the establishment. For reservations made with payment during the booking process, no refund will be granted.
5.5.6. Unless expressly stated otherwise, particularly in the case of extras purchased for this purpose, guests must vacate their room before 12:00 PM on the day of departure. Late check-out may be offered subject to hotel availability. Additional charges may apply depending on the departure time. Please contact reception to check availability and applicable conditions. If the room is not vacated by the deadline, a charge equivalent to an additional night's stay may be applied, depending on the room category and the applicable rate for the date in question. In the event of unavailability, TERRASS HOTEL reserves the right to access the unvacated room to prepare it for new arrivals.
5.5.7. Without prejudice to the application of the right of cancellation under the conditions of article 5.5 for "Flexible rates", any failure of the Client to present themselves at the establishment or no-show (reservation not cancelled in case of right of cancellation and client not present) without prior notification to the establishment to take possession of the room which they have reserved, constitutes release of their reservation in its entirety implying the release of the night(s) reserved and automatically entails the payment of the first night of the costs relating to the reserved stay, including all extras reserved, all taxes included without any right to reimbursement for the benefit of the Client.
5.5.8. The conditions mentioned in article 6 shall prevail over all booking methods: internet, email, telephone or social networks.
ARTICLE 6: RATES & PRICES
6.1. The prices for booking services are indicated before and during the booking process. Prices are valid in real time and are displayed under the conditions stipulated in Article 5.2.4. Similarly, for other booking methods by telephone or email, the rates are valid at the time the booking request is made by the Client. They are also accessible under the heading "View available rates on the calendar." In any case, the specific pricing conditions related to each rate/room type, or additional services, are displayed next to each service booked by the Client.
6.2. The prices quoted are per room and per adult. It should be noted that the chosen rate implies, by default and unless a specific "extra" is purchased, a check-in time of 3:00 PM and a check-out time of 12:00 PM. A credit card imprint and proof of identity will be required upon check-in. If the client fails to present the required documents upon check-out, TERRASS HOTEL reserves the right to charge the credit card provided during check-in.
6.3. Prices are subject to value-added tax (VAT) and are displayed inclusive of all taxes at the rate in effect at the time of booking confirmation, in Euros or in the currency selected by the customer. Displayed prices are valid only for the period indicated on the website.
6.4. If payment is made in a currency other than the currency of the client's country of residence, the exchange fees will be borne by the client.
6.5. All reservations are payable in Euros as specified during the booking process.
6.6. Unless otherwise stated, additional services and other extras selected are not included in the price. However, the price of these additional services, confirmed in the Client's booking, is payable during the online or offline booking process if it differs from the "Flexible Rates." These rates are also subject to VAT at the rate in effect at the time of booking, where applicable, according to the regulations governing these categories of products or services, at a rate different from that applicable to room bookings.
6.7. Tourist tax: The amount of the tourist tax is provided per day and per person, for informational purposes only, and is subject to change. This tax, collected for the benefit of the City of Paris, must be paid on site during your stay.
6.8. Prices include VAT applicable on the day of the order and any change in the applicable VAT rate will be automatically reflected in the prices indicated, in particular in the event of a change in the rate applicable on the day of consumption of the stay and Extras subscribed to compared with the rates applicable at the time the reservation was made.
6.9. If a rate implies that payment is made at the establishment upon arrival or departure from your stay, and the client's currency is not the same as that of the country in which the establishment is located, the rate charged by the latter may differ from that communicated at the time of booking, taking into account the possible evolution of exchange rates between the date of booking and the dates of stay at the establishment.
6.10. Any item stolen from the room during your stay will be charged at the current rate. Rates are available at the reception of each establishment.
6.11. In the event of damage to the room, common areas or various objects, TERRASS" HOTEL reserves the right to charge the customer at the rate of the damage caused.
ARTICLE 7: PAYMENT
7.1. The Client provides their bank details as a guarantee of the reservation except for special conditions or rates requiring online payment as stipulated during the booking process and, in particular, those offered under the headings "internet, best available rate".
The entry of payment information is secured by SSL encryption. The following information will be requested to finalize your reservations: card number, expiry date, and security code for online payments made via the dedicated payment platform. The same applies to the provision of bank details for reservations made by telephone or email, according to the required procedures, which may involve either payment at the time of booking or a security deposit via credit card authorization, depending on the reservation price.
7.2. Payment is debited at the establishment during the stay, except in the case of special conditions or rates where payment is debited at the time of booking when it concerns certain rates subject to the requirement of payment during the booking process according to the specific contractual conditions previously accepted by the Client.
7.3. The service provider chosen by TERRASS HOTEL to secure online credit card payments verifies the validity of the customer's payment card. A payment card may be declined for several reasons: stolen card, blocked card, spending limit reached, incorrect entry, etc. In case of difficulty or impediment, the customer should contact their bank to identify the origin of the card and the hotel to confirm their reservation and payment method.
7.4. If the customer books several rooms but payment, online and in any case during the booking process, is only required for one room for example, in this case, the payment card which is used on the payment platform allows, on the one hand, to pay for the room concerned by the online payment and, in any case during the booking process, on the other hand to serve as a guarantee for the other rooms.
7.5. At the time of online payment and in any case when required during the booking process, the amount which is debited at the time of booking includes: the price of the accommodation, the taxes related to the accommodation, the price of additional services or "extras".
7.6. In the case of a rate subject to online payment, the debit is made at the time of completion of the reservation by the Customer following an online computer debit process.
7.7. Following the stay in one of the TERRASS" HOTEL establishments and regardless of how the reservation took place, an invoice is drawn up in duplicate by TERRASS" HOTEL, one copy of which is given or sent by email to the Client upon his departure from the establishment.
7.8. During the Client's stay, if payment has not already been made online and in any case during the booking process, and if the amount of the Client's invoice exceeds the value of 400 Euros, the Management may demand payment for the service provided, for said stay, in the manner provided for in this article 7.
7.9. Payment by check is not accepted, whether it concerns temporary accommodation services, catering services, or any other services or sales of products provided by TERRASS HOTEL to the Client during their stay at the establishment.
7.10 In any event, any "Extras" or other service which has been booked and delivered by TERRASS" HOTEL during the Client's stay and which has not been prepaid at the time of booking must be paid for by the Client no later than at Check-out.
ARTICLE 8: COMPLAINTS
8.1. For any complaint, the Customer is invited to send a letter or email to:

8.1. TERRASS HOTEL is bound by the guarantee of conformity of services, under the conditions set out in Article L. 111-2 of the Consumer Code, without prejudice to any additional contractual guarantee which may be agreed particularly between the parties, outside of these general conditions, according to a written contract duly signed by the parties.
8.2. TERRASS HOTEL strives to ensure that the photographs, graphic representations, and texts provided give as accurate a view as possible of the accommodation, catering, and other additional services offered. However, the photographs are not contractually binding because, firstly, the different rooms, even those at the same rate, vary in size, and secondly, variations may occur, particularly due to changes in furniture, new decor, or renovations. Subject to availability, except for a reservation made with an express request for a specific room and confirmed in writing by TERRASS HOTEL, the Client cannot make any claim in this regard, provided that these variations do not affect the essential characteristics of the service.
8.3. TERRASS HOTEL cannot be held responsible for the non-performance or poor performance of the reservation in the event of force majeure, acts of third parties, acts of the client or acts of its partners such as the unavailability of the internet network, impossibility of access to the website, external intrusion, computer viruses or in the case of online payment the refusal of the cardholder's bank to authorize the transaction.
8.4. Although TERRASS HOTEL offers internet access via Wi-Fi in the establishment, in the event of a failure of this service not attributable to the establishment, whether total or partial, for any reason whatsoever, during the stay in the establishment, the Client shall not have any right to cancel the reservation, nor to a refund of the reservation, nor to any compensation whatsoever.
8.5. TERRASS HOTEL shall not be liable for any indirect and/or intangible damages, including, but not limited to, loss of profit, loss of business, acts of third parties, acts of the customer or acts of its partners.

8.7. The client agrees to use the safe in their room for all valuables and sums of money worth three thousand (3000) euros or less, or failing that, to deposit them in the hotel's central safe, and to deposit in the hotel's central safe any items and sums of money worth more than three thousand (3000) euros.
8.8 TERRASS HOTEL cannot be held liable for damage caused by animals present on the premises, as these remain the responsibility of their owner or keeper in accordance with the provisions of Article 1385 of the Civil Code. ARTICLE 9: MEDIATOR
In accordance with the provisions of Articles L 611-1 and R 612-1 et seq. of the Consumer Code concerning the amicable settlement of disputes, when the consumer has sent a written complaint to the professional and has not obtained satisfaction or a response within two months, he may submit his complaint free of charge to the consumer mediator.

ARTICLE 11: DATA PROCESSING, FREEDOM AND PRIVACY, RIGHT TO ONE'S IMAGE
11.1. The information requested from the Client during the secure booking process is mandatory if marked with an asterisk for Biografy Group, acting as data controller, its service providers (payment, online booking) acting on behalf of TERRASS HOTEL.
They enable order processing, customer file management, and newsletter management.
Regarding the newsletter, the Customer may agree to receive special offers and information about any new services created by TERRASS HOTEL via email or SMS. They are informed that they can unsubscribe at any time by clicking on the dedicated link in the email or SMS.

In accordance with the provisions of Law No. 78-17 of 6 January 1978 relating to information technology, files and freedoms as amended, each Client has a right of access, rectification, objection, erasure of information concerning him/her by contacting reservation@terrass-hotel.com .
11.2 By accepting these General Terms and Conditions of Sale, the Client acknowledges and accepts that TERRASS'' HOTEL may, for the proper execution of the Services, collect his telephone data.
In accordance with Article L. 223-2 of the French Consumer Code and Law No. 2014-344 of March 17, 2014, relating to consumer affairs, the Customer has the option to register free of charge on the national telephone marketing opt-out list, BLOCTEL ( www.bloctel.gouv.fr ), in order to stop receiving unsolicited sales calls. The Customer can register for free on this list on the BLOCTEL website.
11.3. Booking overnight stays and/or Extras at the establishment in question and their consumption by Clients and/or their companions, or even simply being present at the establishment, does not authorize any audiovisual recording, filming, or photography whatsoever in the premises and outbuildings of the establishment, including guest rooms, for commercial, promotional, advertising, press relations, or public relations purposes, website illustration, etc., and more generally for any collective use or use likely to involve the public. The interior architecture and graphic designs adorning the common areas and guest rooms of the establishment are protected by copyright, all rights of which are fully reserved. Any audiovisual recording, filming, reproduction, or representation of images featuring the premises and outbuildings of the establishment in question, other than for strictly private use, is subject to prior authorization from TERRASS HOTEL, under penalty of infringement punishable, in particular, by the civil and criminal provisions of the Intellectual Property Code.
ARTICLE 12: MISCELLANEOUS
12.1. These general terms and conditions are governed by French law.
12.2. In the event that any provision of these general terms and conditions is declared null and void, in any way and for any reason whatsoever, it shall be deemed unwritten and shall not invalidate the other provisions.
All disputes that may arise between the parties in connection with the interpretation and/or execution of these general terms and conditions shall, in the absence of an amicable agreement, be submitted to the exclusive jurisdiction of the competent court within the jurisdiction of the Court of Appeal of Paris, with the exception of disputes concerning non-commercial persons for which the legal rules of jurisdiction apply.
12.3. Please note that all rooms are non-smoking. If you light a cigarette inside the TERRASS HOTEL, we will be obliged to charge you a cleaning fee of 80 euros to your credit card.
12.4. Many decorative items are displayed in our rooms. If you like them as much as we do, you are welcome to purchase them. If you happen to leave with one or more items, TERRASS HOTEL will charge your credit card directly. Our rates are available at reception.
12.5. The TERRASS'' HOTEL has some rooms accessible to people with reduced mobility. These rooms are allocated subject to availability. Please inform us of your specific needs when making your reservation so that we can check availability with the hotel.
